Hi there,
I am going to apply H4 VISA for my spouse, but we don't have any marriage pictures. and the problem is I am here in USA and she is back home, and i can't go back home because of my project.
I came to know that pics are very important for H4 Visa.....Anybody have any suggestion...

Yes, you can ask CIS to extend the RFE deadline and explain the circumstances. It is critical to make this request before the first deadline has passed.

FOlks,
I am tired of this GC process like u all are. the following is my situation.
Currently on H1B and 140 cleared with company B, no 485 applied missed the boat during the VISA bulletin fiasco(USCIS money making scam)
i have a future GC with COMPANY A, 485 applied, i have EAD/AP also.
i am tired of my current job, too much exploitation, i want to change, so my question is can i just take some other permanent employment using this EAD/AP
My question is as this future GC with COMPANY A and i have never worked for this company A. can i do a AC21 and move on ?
does AC21 apply future GC. ?
Appreciate any thoughts in this matter

I have a valid H1B visa stamp from company A. Now if I transfer my h1B to company B, and decide to travel outside US, do I need to go to the consulate and get a new visa stamp ?

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?

My current H1 expired on 7/9, I applied h1 extension (with approved I140) on 6/30/10 with client letter (with no end date) and other documents. I got approval last week, they approved my petition from 11/18/2010 - 11/17/2011. 10th year extension.
1. What is my status between 7/10/10 - 11/17/2010?.
2. Do i need to inform USCIS?
3. I expected 3 years, but I got only one year.
Is anybody faced similar situation or any suggestion.

First Labor (EB3) : Filed : Apr'03, Approval : Jan'07
First I-140 : Filed : Feb'07 Denied : May'07 Appeal : AAO, Approved : May'10 with one RFE

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

One of my friends has goofed up his labor filing:
His actual date of termination with his previous company was 5/31/2007, but in the labor filing he has said that he was employed with the previous company till 6/30/2007....
he is ready for filing his 140(EB2)? can he correct his dates of when he files for 140....
WILL HE HAVE TO file for labor again??????????:(

continuedProgress: AFAIK & IMHO - Only people in valid H/L status can travel outside USA while AP is pending. Your wife is on F1, if she travels outside USA with out the approved AP on hand, her 485 is considered abandoned. You can have second opinion with your attorney.

Can anyone help me know of a process by which I can get my duplicate W2 form. The scenario is that I asked my employer to send me the W2 form and they say they did send it via post. But I did not receive it. Also my employer says they have not received it back. I need to file my taxes(Fortunately I had applied for extention) and don't have a W2 to attach with it. Can anybody help me with knowing the process

In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...
